MCA Required to File DIR-12 for Company Registration in India

MCA required to File DIR-12 (previous form was Form 32) for Company Registration in India for Appointment of Directors, Manager etc...

As the DIR-12 required to file for appointment of Directors, Managers etc. for registration of new company in India, there also required some of the document before filing DIR-12 which is as below:-

• Letter of Appointment :-

Letter of Appointment to be made by addressing the proposed director Name, Address. This letter is very simple to write just like any other letter, there is no such format prescriber for this letter.

• Declaration by First Director :-

This is required for every subscribers of the memorandum i.e. whose name was entered at the time of filing form INC-1. This letter contains declaration that director will not accept any public deposit unless compliance fulfilled with RBI Act, 1934 and SBI Act 1992 in addition to the Companies Act.

• DIR-2 (Declaration by the appointee director :-

Consent to act as director in form DIR-2 required from every proposed director of the Company. Such declaration required in pursuant to the Companies (Appointment and Qualification of Directors) Rules, 2014 and Companies Act.
