Details Procedure for Name Approval before Company Registration in India:

Name Approval Form INC-1 is required to be filed as per section 4(4) of the companies Act, 2013 and as per rule 8 and 9 of Companies (incorporation) Rules, 2014. Name approval is very important for any Company Registration in India with MCA. One Name is approved there is nothing hard in Company Incorporation. For Company Formation name of a proposed company shall not be identical or resemble to the name of an existing company or use of such name will not constitute an offence under any law or is not undesirable in the opinion of the central government.

In selecting name of a proposed company we should take care, whether the proposed name is existing in Trade Mark directory or in MCA directory. Most reason for rejection of a name for company registration is Purpose of the proposed company is not clearly mentioned in name. Example:

1. For IT Company name like “ABC IT Services Private Limited or ABC Technology Private Limited or ABC IT solution private limited etc..”
2. For Construction Company name like “ABC Construction Private Limited or ABC Buildcon private limited or ABC Infratech private Limited etc.” 

 

 

As per Name Availability guidelines it is not necessary that proposed name of a Company should contain main object of the company but the proposed name of a company must contain any of its object mentioned in form INC-1.
