Rule 8 Companies (Incorporation) Rules 2014 guide in selection of a
proposed name of a company whether a proposed Company name is similar with
other Company and differences on following ground shall be disregarded :-
- The Word like Pvt, pvt., private, (p), Limited, Ltd., Ltd, Limited Liability Partnership, LLP;
- Company, co, Co., and Company, Corpn, Corp., Corp, Corporation;
- Name should not be plural version of any word appeared in the Proposed Company name;
- Punctuation marks, space between letters and type & Case of letters.
- Separated or joined name, joint word together and its separation doesn’t mean different name.
- Use of different tense for same name doesn’t mean different name.
- Using of spelling variations for same name and using different phonetic spelling does not mean different name. For example “D.P. Real estate Private Limited” Company is already existing before registration of other company then D and P Real Estate Private Limited or D and P Real Estate or Dee Pee Real Estate private Limited or D n P Real Estate shall not be allowed. Numeric word like “7” resemblance shall be checked with “SEVEN” also.
