Company
Registration in India is simple only if the proposed company name is unique and
distinguishable from any other company already registered with MCA otherwise Company
Formation procedure is not simple in India. Before Company Incorporation Name
selection procedure will attract many condition which is mentioned below in
accordance with Rule 8 of Company (Incorporation) Rule.
Company
Name with following word shall be disregarded for Incorporation in India with
Ministry of Corporate Affairs:
1.
Name of a Proposed Company which contain an
internet related word such as .edu, .gov, .com, .net, .in .org, does not make a
name different from another even where . is written as ‘dot’
2.
Adding the words like Jai, Shree, Modern, New, Nav,
Shri, Sri, Sree, Jai, om, The, etc. does not make a name different from an
existing name and similarly, if the above proposed name is different from
existing company’s name only to the extent of adding the name of the place,
then such name shall not be allowed; such names can be allowed f no objection
certificate obtained from the existing company in form of Board resolution.
3.
Proposed Company name shall be considered
undesirable if
(i) Provisions of section 3 of the Emblems and
Names (Prevention and Improper Use) Act 1950 apply to proposed name
(ii) Proposed
Name includes the name registered trade mark of another company or a trade mark
for which application for registration has been filed unless the consent Letter
of the Trade Mark owner or Trade Mark applicant for registration has been
obtained in written letter and such proof produced by the promoters
